1. Acceptance of Terms

Welcome to GenerateExam.com ("we," "our," or "us"). By accessing or using our website at GenerateExam.com (the "Site"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to all of these Terms, please do not use the Site.

2. Eligibility

You must be at least 13 years old to use this service. By using the Site, you represent and warrant that you are at least 13 years of age. If you are under 18, you may use the Site only with the consent of a parent or legal guardian.

3. User Accounts

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Credits and Payments

Free Credits: New users receive 10 free credits upon registration. Free credits are non-refundable and expire 30 days from the date of issue if not used.

Paid Credits: Users may purchase additional credits. Payment must be made through the available payment methods (PayPal or UPI). Paid credits are non-refundable, except as required by applicable law. Paid credits are valid for 30 days from the date of approval by our team.

Credit Consumption: Each exam generation or question set generation consumes 1 credit. Credits are deducted at the time of generation, regardless of whether the user completes or uses the generated content.

Expiration: Unused credits expire automatically after their validity period. We are not obligated to provide refunds or extensions for expired credits.

5. Use of Service

Our service allows you to generate AI-powered multiple-choice questions and exams. You agree to use the service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the service in any way that violates any applicable federal, state, local, or international law or regulation.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the service, the server on which the service is stored, or any server, computer, or database connected to the service.
  • Use the service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without our express written permission.

6. Content and Intellectual Property

Generated Content: All content generated by the AI (questions, answers, explanations) is provided for educational purposes only. We do not claim ownership over the generated content; however, by using our service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content to the extent necessary to provide, improve, and promote the service.

Site Content: The Site itself, including its design, text, graphics, logos, and software, is the property of GenerateExam.com or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on this content without our prior written consent.

AI-Generated Content Disclaimer: The questions and answers generated by our AI are for informational and educational purposes only. We do not guarantee the accuracy, completeness, or reliability of any generated content. Users are responsible for verifying the correctness of the material before using it in any formal or academic setting.

7. Prohibited Activities

In addition to the restrictions in Section 5, you may not:

  • Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
  • Attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
  • Otherwise attempt to interfere with the proper working of the Site.

8. Termination

We may terminate or suspend your account and access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GENERATEEXAM.COM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE SITE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (iii) ANY CONTENT OBTAINED FROM THE SITE; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

You agree to defend, indemnify, and hold harmless GenerateExam.com, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Site caused damage to a third party.
